TERMS AND CONDITIONS

DEFINITION OF SHORT TERM versus LONG TERM
The standards in Peru are the following:
For SHORT TERM rentals (less than 4 weeks or 29 days) the norm is the price includes all the normal costs of an apartment. But the price does NOT include telephone calls or internet charges which are made using pre-paid calling cards. Although electricity is included, we will charge for any excess that is above the normal usage band.
For LONG TERM rentals (greater than 1 month or 30 days, with a minimun of 3 months rent) the monthly price shown DOES NOT include the ongoing monthly costs such as building maintenance, taxes, electricity, water, phone, cable and Internet services etc. These individual costs are the responsibility of the tenant that wish to rent for a long term (more than 1 month).
From the start of the reservation, the guest agrees and accepts all the Terms and Conditions as shown below. Note.- The monthly price rate is for 30 days not for 31 days.
Everybody who makes a reservation with Mirapartment hereby agrees to be in total agreement with our terms and conditions stipulated in our reservation process explained lines below.
STEPS FOR CONFIRMING A RESERVATION
1. - The reservation starts by getting in contact with Mirapartment Rentals by our website, e-mail or telephone and providing all relevant information of the guests including full name as shown on official ID, ID information (Passport Number and Country if Peruvian DNI), age and address of each guest, and dates of the rental. The person who makes the reservation must be of legal age in their country of residence and guarantee to be financially responsible for the payment of the contracted services. Please note that the apartment requires a minimum rental amount of 4 nights.
2. - Within two business days, you will receive an answer about the availability of the apartment for the requested dates with a payment reservation. Reservation offer is only good for 2 days or 48 hours.
3. - Once this payment is made, Mirapartment Apartments will confirm the reservation.
4. - All the prices published by The Mirapartment Apartments are expressed in US Dollars, thus, both the payment for the rent and the guarantee must be made in the same currency. Credit cards, checks (of banks with no agency in Peru), travelers' checks and bank notes in bad condition, torn or taped, will not be accepted. Deposits and transfer are accepted but it needs to be cleared first then we can make the contract.
5. - The balance of rent is due in cash when you arrive at the apartment.
This contract represents the entire agreement between the parties and replaces all prior understandings (oral or written) covering the subject matter and can be changed only in writing signed by both parties. No firm booking can be made until the Booking Contract is completed.
At the time and date of the guest's arrival, previously decided in advance with no less than 72 hours notice, a representative of the Apartment will be waiting for you at the rented apartment. At this time the following steps will take place: A. The contract between the tenant and The Mirapartment representative will be signed by the tenant and our representative and a copy of this contract will be provided to the guest. Moreover, guest(s) will need to present their ID card(s) or passports and provide a copy of each ID/ Passport.
B. The inventory of the apartment will be checked and signed.
C. The amount outstanding and security deposit will be paid only in cash, in US Dollars. This money should be paid at the time of the arrival to the Apartment or Check-In.
D. During check-in, the guest will receive information regarding the property, the zone, emergency telephone numbers and other relevant information that may help to make their stay more comfortable.
E. If any information provided by the guest(s), in the reservation form or the signed contract is found to be false; or if there are guests staying in the apartment that are not registered, The Mirapartment representative will proceed with eviction, the tenant thereby losing all rights to restitution of payment(s) made.
F. When checking-out, the guests must leave the apartment in the same condition in which the apartment was found. This includes the verification of the inventory taken on arrival.
G. The Mirapartment apartments will not take responsibility for the loss of any items of the guest(s) during their stay in the apartment.
H. Once the contract is finished and the guest has left the apartment, The Mirapartment apartments will not take responsibility for lost or forgotten objects in the property.
I. It is forbidden to have in the apartment (not even temporarily) wet, infectious, foul-smelling, explosive and/or dangerous materials or drugs. Any risks, trouble or situations that may be made against the security of the property or its conservation; or against the calmness of the neighbors will be under penalty of contract cancellation with no monies refunded.
J. For your security, under no circumstances; the apartment keys should be leaving at the front desk.
The guest will have to pay in addition to the rent, a security deposit which is based on the total amount of the stay (minimum $300.00 / maximum two month's rent). This security deposit will be returned during the check-out process after review of the signed inventory. In the event the apartment or any of the apartment's furnishing is damaged, the guest will pay those expenses according to the values established in the inventory. In case the security deposit does not cover the full cost of damages for any or all items, the client agrees to pay the difference immediately on request to one of the representatives of The Mirapartment Apartments.
On arrival the tenant must provide a photo copy of their id / passport which must match the information provided when confirming the reservation.
PASSPORTS, VISAS, INSURANCE AND HEALTH REQUIREMENTS
The country's Policies, Rules & Regulations related to Passport, visa, insurance and health requirements for visitors are subject to change at any given time and it is the tenant's responsibility to check the current / existing status prior to arrival. It is the tenant's responsibility to keep their passport, travel documents, insurance policies and medical records intact and valid for travel. The Mirapartment Apartments are under no obligation to assist the tenants in obtaining valid travel documents.
The Mirapartment Apartments can refuse to accommodate the tenants if they do not have a valid visa or and entry permit. If such event occurs The Mirapartment Apartments will not be liable for any refunds or compensation. The Mirapartment Apartments are unable to accept any liability for any delay to your arrival, whether the delay or cancellation is caused by adverse weather conditions, the action of air traffic controllers, the action of airport authorities or governments, the rescheduling of times by the airline, mechanical breakdown, strike or industrial action or otherwise. In such circumstances the tenant is responsible to have the necessary insurance policy to cover their losses.
The Client shall submit Total Rental payment upon arrival. If any payment is not made within the times set forth herein, The Mirapartment Apartments may treat the contract as cancelled, and the usual refund terms shall apply. The deposit to reserve an apartment becomes nonrefundable if the booking is not cancelled more than 30 days of the date of arrival. Part weeks are charged as a percentage of the weekly rate. Also if the booking dates fall in the weekend we will add $20 dollars extra per night on Saturday and Sundays as part of the weekend rate.

PayPal is the Fast; secure way to pay online without sharing your financial information with the recipient. PayPal charge a small fee of 4.01% to use Visa, MasterCard, or American Express.
You will recieve a private contract with a summary of money paid along with an Inventory List and the apartment keys.
NUMBER OF OCCUPANTS
The total number of guests staying at the property may not exceed the number of sleeping places specified in the promotional material. Our standard rate is based on 4 people any additional guest will pay $20 for each extra night staying. We reserve the right to refuse entry or evict the entire party if the number of persons occupying a property exceeds the number stipulated in this contract. If the total number of guests exceeds the number stated in the Reservation and no permission has been granted to exceed the capacity of the Property. We reserve the right to terminate the reservation and/or levy a charge as it will be considered an amendment by the tenant. No compensation will be due from the owner as a result of cancellation or termination based on exceeding occupancy limits. The occupant needs to follow rules of the building and comply with them, according to Building Regulations.
NUMBER OF GUESTS
We must to inform with the total number of guests and only the persons indicated in the reservation will be authorized to use the apartment. In the description of each apartment we show the maximun allowed people to use the apartment . In case we detect that the contract is not being followed, we have the right to ask our guests to leave the apartment without any refund of money paid. The number of guests that use the apartment may not exceed the established capacity; if the number of guests should exceed the capacity, we reserve ourselves the right to ask the customer to leave the property without having the right to claim any compensation.
Visits are allowed in the apartment. All visits and guests must be announced. Consult with the landlord and let the porters know you are expecting someone (in this order). Following building regulations, guests may be required to show proof of identity for security. Monthly rentals tenants have 2 days of free visitor fee. Other people living in the apartment other than the people listed will have to pay a fee of $20.00 extra per day, always consult with the landlord about this issue first. No smoking is permitted in the apartment.
No pets are allowed in the apartment or the building. If a pet of any kind is found in the apartment, occupant will be asked to vacate immediately.
For the comfort of all building occupants, no loud, no loud music, no fights or annoying activity is permitted in the apartment, is this happens occupant will be asked to vacate the Apartment immediately.
CLEANING CONDITIONS FOR THE APARMENT
We will apply a one time only cleaning fee of $50.00
The cleaning fee is a fee for final cleaning, after leaving the apartment. It is NOT a payment for cleaning services during your stay in the apartment.
If you need extra cleaning services while you are at the apartment please let us know so we can refer you to our cleaning staff, an additional fee will have to be pay to use this service. Thanks
An additonal extra charge fee of between $30 and $80 dollars will be charge to your bill if we found the apartment must have an extensive cleaning for misuse of the apartment (ex. drop fat or grease in the oven or stove as well as counters or walls, pots burned, lids burned or lost, greasy spots or burned in the stove, broken dishes or broken glasses, heavy spots or marks with pens, or marks left in the couches, on the wall or in the floor, soiled linens and towels, lost towels used as mops or used as wipes or rags to clean the floors, torn quilts, comforters or pillows soiled, dirty or spotted with grease or body oil, heavy smells, strong odors or smelly or stinky smells inside of the apartment or inside of the appliances and refrigerator,etc).
If we can not find items left in the apartment and accounted left in the apartment at the time of admission as towels, dishes, pots, appliances, glasses, linens etc a separate fee charge or and additional fee will be paid or will be deducted from your security deposit to remedy this problem. EXPENSES PAID LOCALLY AT EXTRA COST
The rental property and any facilities or services expressly included in the written information provided by The Mirapartment Apartments are included in the contract price. Normal use of gas, electricity and water as well as building maintenance is included in short term rentals. These costs are NOT included in long term rentals unless otherwise stated in the comments. Local expenses are excluded from the rental cost specified in this contract, such as Telephone abuse, cleaning services, linens, heating, and personal services such as maids or cooks. The Mirapartment Apartments will list known locally paid expenses on the Confirmation Invoice.
Although electricity is included, we will charge for any excess that is above the normal usage band
CHECK - IN / CHECK - OUT *Day starts at 4:00PM and ends at 10:00AM*
1- CHECK - IN TIME: (4:00 PM / 16:00) If the guest wants to occupy the apartment before the check-in time, he or she will need to request the reservation for the day before his/her arrival, and he/she will have to pay an additional day. Regarding Transportation after hours of operation If the client arrival is after hours of operation or out of regular hours, there will be a charge of $15 for Check In after regular hours for transportation purposes and waiting time paid to the administrator. Regular hours of Check In are from 8:00AM to 08:00PM
2- CHECK - OUT TIME: (10AM / 10:00) if the guest wishes to depart after this time they must arrange with The Mirapartment representative in advance regarding additional charges, whenever is possible and depending in our availability. if the clients wishes to leave or depart after the regular check out time, then the client will have to pay an additional day. At any case, If the Client wishes to leave or Check Out before regular hours they will need to coordinate with Administrator.
3- The check-in and check-out dates to the apartment will need to be coordinated with The Mirapartment representative at least 72 hours in advance.
4- During check-out, the guest will return to The Mirapartment Apartments representative the keys and any other supplied items. E.g. garage remote control, provided cell phone, etc.
EXTENSION OF THE STAY
The lease agreements cannot be extended. In the event the guest would like to extend their stay they must contact The Mirapartment Apartments as soon as possible, in order to check on the continued availability of the apartment. A new lease agreement will need to be signed, and there may be some modifications, including possible changes in rate.
For rentals greater than two months, the rental will be paid monthly to The Mirapartment Apartments by previously made arrangements. If the guest decides to cancel the contract in advance they lose the security deposit, and may be liable for additional charges due to breach of contract.
The Mirapartment Apartments has taken care to ensure the accuracy of all information and descriptions contained in its promotional material at the time prepared, however, nothing in those materials shall be treated as a term or condition of this contract. The Mirapartment Apartments shall not be liable with regard to any difference of opinion as to the condition or quality of the properties, or the surrounding area, nor for temporary defects or stoppages of any utilities. Our photos are recent but may not always appear exactly as pictured or described due to normal wear and tear, changes in furnishings between audits and changes after materials were prepared.
MAINTENANCE If for any reason one of the services need to be installed fixed or upgraded, the guests need to allow workers entry into the apartment.
If any of our guests do not follow the rules of the property we have the right to ask our guests to leave the apartment without any refund of money paid.
We hope that all your inquieres are resolved for a pleasent stay in our instalations
Should any problem occur with the property, the Client must immediately (within 24 hours) notify The Mirapartment representative directly. The Client should allow The Mirapartment representative reasonable time to remedy the problem. Vacating the property without The Mirapartment representative authorization does not constitute an adequate cause for a refund. The client books a property in Lima with the understanding that there are cultural, architectural, economical and natural differences from the other parts of the world.
CANCELLATION OF THE RESERVATION
In case the guest cancels the reservation before 45 days, including at the time of check in, the deposit and booking fee will not be returned nor will any additional payments made to guarantee early check-in or late check-out. Any cancellation during the contract period will be considered breach of contract. If The Mirapartment Apartments decides to cancel the reservation for any reason, the guest will be able to receive a full refund of any payments made.
Refunds will be honored if reservation is cancelled within 3 days of submitting first payment. After 3 days, no refunds will be granted. Reservations made within 4 weeks of check in date will not be refunded.
For security reasons, please note that all the payments made by PayPal and credit cards needs to be accompany with a copy of the Passport o official ID or DNI, also we need to make copies of the Passports and Immigration entry cards stamped in Peru of all the members staying in the apartments at the time of check-in
- Cancellation must be made in writing 45 days in advance and a cancellation fee will apply. Cancellation fee is $300
- Less than 30 days before arrival, cancellation is Non-refundable
- Changes are subject to availability with a $150.00 change fee
- No money will be refunded if the guest leaves the apartment before the check-out date; it will be considered as compensation for breach of contract.
With making the reservation, the guest agrees and accepts all the Terms and Conditions, Conditions of Reservation and Cancellation Policies established by the Mirapartment Apartments
In case the apartment does not meet the client's expectations, it is the renter's obligation to let it know at the Check in Time. It is completely unacceptable to stay in an apartment and wait longer or until returning home to express dissatisfaction and try to get a refund.
Mirapartment Rentals shall not be responsible or liable for any accident, loss, damage, injury, or inconvenience arising from the rental, except insofar as that occurrence is caused by the direct negligence of The Mirapartment Apartments. The Mirapartment Apartments does not accept liability for any loss or damage caused by weather conditions, riot, strikes, sickness, emergency decision in the buildings or any cause beyond its control.
The Mirapartment Rentals cannot be held liable for situations arising outside of their control ("Force Majeure"). The following definition is the basis of the term "Force Majeure", which means any event The Mirapartment Rentals could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, acts of God, acts or regulations of any governmental or supra-national authority, fire, emergency decisions in the buildings beyond our control and all similar events outside our control.
PERSONAL INFORMATION AND DATA PROTECTION
At the time of entering the online registration form, you are required to submit personal information. Your personal information will be kept confidential and used to by Mirapartment Apartments. Mirapartment Apartments, on a continuous basis, endeavors to protect your personal information by implementing appropriate security procedures.
Mirapartment Apartments and its Client agree that this contract shall be governed by Peruvian law, and that exclusive jurisdiction over all disputes arising out of this contract shall be in the courts located in Lima, Peru.
